Yes it is. I know for a fact that Best Buy regularly prices new released at below cost. They lose money for the first couple of weeks on these releases just to get you in the store where they flash all kinds of goodies at you to get you to walk out with more than just that CD. Some don't buy anything else, but some do.
I worked at a CD store for 4 years. We could have charged anything we wanted for anything we sold, new or used. We usually marked up by 30% or so from our cost...sometimes less, sometimes more. The labels/bands do NOT set pricing for CD's the way companies like Apple and Sony do for thier iPods and video games. That's why there can be a $4 difference between Target and Best Buy on a CD, but a PS-3 game will cost the same.
