In my town there was (still is) a local band called HEAVEN AND HELL since 1992, of course long before the DIO fronted Black Sabbath renamed them.

They were a cover band and quite good at it, I saw them once at a Rocker-club, but also had some material of themselves, I think if I recall what their female singer told me right, they had not even tried to contact the heavyweigts but changed their name into Astrum et Abyssum ( which is the same in Latin!) .... so I guess Tony is right, depends who has better lawyers or in this case is simply more well known ?
