RE: Gimme a f@*#ing break!

Eric wrote:
-------------------------------
According to some people's logic, the Journey album is up for grabs at Napster because it isn't released yet - that that somehow makes it not stealing.

I guess then if somebody that worked for say Microsoft stole a new OS they were working on, and began distributing it on Ebay it would be okay because the product isn't for sale yet?
--------------------------------

Without incriminating myself, I'll say that I have seen every OS from Microsoft since Windows 95 far in advance of it's official release date, both in beta and the full release form. If I did happen to try it out, I always got the official CD later on anyway if for no other reasons than 1) Hard drives weren't always as big as they are now and 2) CD burners weren't always as inexpensive.

In anyevent, Eric, you are putting words into my mouth that I never said. When did I say one word about Ebay, or about making money off of Napster at all? The CD's I will burn from my own Napster downloads are for my personal use. As I said in a previous post, they are 99% material that is not at all available commercially, nor likely will ever be. And if Van Halen, The Stones, U2, or whomever decide to release a "Beatles Anthology" type of product that has some of this bootleg material on it, I'll be the first one to buy it because it's guaranteed to sound better than the bootleg versions. If anyone IS selling the new Journey or new Van Halen album on E-Bay, then yes they WOULD be stealing, because they are making money off of someone elses work.

It comes down to this.. Since the invention of MP3's (and especially since Napster) I haven't bought one bootleg CD. I DO continue to buy the commercially released CD's, although there haven't been many worth buying lately. Do I feel guilty that the bootleggers are losing money? Not in the least. Do I support free trading of non-commercial music files. Damn right I do!

fcvh7896

Let me get this straight, F.O.R.D.: If I were to walk into 5150 and dubbed me a copy of every song Van Halen have recorded with DLR so far and put them up on the Net so every Napster dweeb out there could download it - that wouldn't be stealing either according to your logic, right? I mean, why give a shit about Van Halen - they're all multi-millionaires anyway and don't need any more money, so why should they (or their label) care what other people do with their creation...?
---------------------------------

If you somehow got a hold of the new Van Halen album and put it on Napster, you bet your ass I would download it! And then I would buy the CD the minute it hit the store. I have dozens of Van Halen & Van Hagar songs on my hard drive right now. Only one of them ("Crossing Over") is commercially available at all, and it's pretty hard to come by. As for TimeWarnerAOLNetscapeEMI, no I really don't think they would miss the money that much even if I DIDN'T buy it, but THAT IS NOT WHAT I SAID John. Until the product BECOMES commercially available, nobody is losing any money. There is little doubt that any bootleg that made it out of 5150 right now would be so poor in sound quality that nobody would settle for that version when the CD came out.

-------------------------------------
Amazing... all you pathetic little fanboys who think you are somehow 'entitled' and have the right to demand when and how you get to hear the next Journey or Van Halen record or whatever, the artists and their wishes be damned, make me ill. There should be someone like the equivalent of the 'Soup Nazi' on 'Seinfeld to set you all straight: "NO JOURNEY FOR YOU!!!!"
--------------------------------------
Ironic you should use that for your analogy..
RE: Journey - Arrival up on Napster

Regarding the Napster deal:

It is quite evident that an argument can be made for either side (okay its on Napster vs. Not okay). I am entirely confused as to which side I'm on. I have decided to wait for the official CD release however.

Argument "okay"
1) Its unreleased
2) Mostly fans that will buy the CD anyway
3) Fans haven't been privvy to any teasers from Journey on their website
4) Journey fans are rabid

Argument "Not okay"
1) It was unfinished, unpolished. It is not the final album - and their "test" material doesn't have a right to be reviewed without their consent. Test products often have problems, and in this case, Journey didn't ask anyone for a friggin Beta Test......The order will be different, the songs will be different, and the quality will be different.

2) There will be some non core-fans and bad music ear people that download it and hear it through their cheesy computer speakers, and say that it's not as good as Perry's era. And I don't want eveybody e-mailing me telling me how great their computer speakers are - many people have a very mono, shit PC sound system.

3) Anyone who downloads it after a certain point MUST realize it's theft. It is now well known that Journey/SONY do not want it out yet.

You are WRONG!!!

Kris, this has got NOTHING to do with 'getting on a soapbox' - it's simply a matter of giving the artist some respect! Somewhere out there is a Journey 'fan' (and I use the term loosely...) who saw it fit to put 'Arrival' on the Net A to Z - a full SIX WEEKS ahead of its official release date! That is FUCKING bullshit and it needs to stop! How would you feel if you worked on a project and someone took it away from you without your consent and showed it/played it for every Joe, Dick and Harry! - You would feel like SHIT and you'd be FUMING! Why can't people be cool enough to sit on something until it comes out, or closer to the release date anyway, instead of completely disrespecting the band just to be "Mr. badass-look-I-got-it-already"? The lowlifes that do this deserve a major beating... and people like you who support these practices should really think through what's at stake here instead of acting like overanxious fanboys. Is your life gonna suck that much if you can't hear a badly mp3'd version of 'Arrivial' RIGHT NOW?

P.S.: If Andrew previews the new Journey you can bet your life he's got PERMISSION to do so! Don't equate him with these Napster clowns!
